Welcome to our website. These Terms and Conditions (Terms) govern your use of our website, participation in fundraising campaigns, purchase of goods and access to our services.

By accessing or using this website, placing an order or registering a fundraising campaign, you agree to be bound by these Terms. If you do not agree, you must refrain from using this website or purchasing our products.

1. Statutory Liquor Compliance & Age Restriction

  1. Underage Sales Prohibition: Under the Liquor Control Reform Act 1998 (Vic) and equivalent state and territory legislation, it is an offence to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.
  2. Proof of Age: Delivery personnel and courier partners reserve the right to request valid government-issued photo identification (such as an Australian Driver’s Licence or Passport) prior to handing over any order.
  3. Refusal of Supply: We reserve the right to cancel any order or refuse delivery if valid proof of age cannot be provided or if intoxication is suspected upon delivery.
  4. Age Declaration: By placing an order for alcoholic products, you explicitly confirm and declare that:
    1. You are at least 18 years of age. 
    2. The intended recipient of the delivery is at least 18 years of age.

2. Orders & Campaign Purchasing

  • Order Acceptance: All orders placed through a fundraising link are subject to product availability and acceptance by us. A confirmation email does not constitute final acceptance of your order.
  • Pricing: All prices on the website are listed in Australian Dollars ($AUD) and are inclusive of Australian Goods and Services Tax (GST) unless explicitly stated otherwise.
  • Fundraising Association: When you place an order via a unique campaign link, a portion of the sale will be credited to the designated club, school, association or partner organisation (Fundraising Partner).
  • Payment Processing: Payment must be made in full at the time of placing an order via our approved, encrypted payment gateways. We do not store full payment card credentials.

3. Delivery, Fulfillment & Collection

  1. Delivery Locations: Orders are delivered to designated pickup locations (e.g. partner club rooms) or directly to individual delivery addresses, depending on the agreed setup for each campaign.
  2. Restricted Delivery Zones: We strictly comply with dry zones, alcohol-restricted areas and local liquor laws across Australia (including remote Northern Territory and Queensland communities). Orders addressed to restricted areas will be cancelled and refunded.
  3. Risk & Title: Title and risk in the products pass to you upon successful delivery or collection at the designated campaign location.
  4. Delivery Delays: While we make every effort to meet estimated delivery timelines, we are not liable for delays caused by logistics partners, extreme weather or events beyond our reasonable control.

4. Partner Organisation Obligations

Organisations partnering with us to host a fundraising campaign agree to:

  • Ensure all promotional materials distributed to members and the public comply with responsible alcohol promotion standards.
  • Avoid targeting fundraising promotions to minors or encouraging excessive alcohol consumption.
  • Coordinate local order pickup or distribution in accordance with local liquor compliance requirements.

5. Refunds, Returns & Cancellations

  • Australian Consumer Law: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
  • Damaged or Faulty Goods: If products arrive damaged or defective, you must notify us within 7 days of receipt with proof of purchase and photo evidence.
  • Change of Mind: Due to the nature of custom fundraising orders, we do not offer refunds or returns for simple change of mind once a campaign has closed and orders have been processed.

6. Intellectual Property

All content on this website, including text, graphics, logos, images and software, is our property or the property of our licensors and is protected by Australian and international intellectual property laws. You may not reproduce, modify or distribute any content without our prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law:

  • We provide our services and products on an "as is" and "as available" basis.
  • We are not liable for any indirect, incidental, special or consequential damages arising out of or in connection with the use of our website, products or fundraising campaigns.
  • Our maximum aggregate liability for any claim under or in connection with these Terms is limited to the resupply of the goods or the total amount paid by you for the relevant order.

8. Privacy

Your submission of personal information through the website is governed by our [Privacy Policy]. By using our website, you consent to the collection, use and disclosure of your information as outlined in that policy.

9. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising in connection with these Terms or your use of the website shall be subject to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.
